Who's Next? (or "Judicial Candidates For Dummies")

Well, the Conservatives wished upon a shooting star and somehow it came true. (Or it could be the SCOTUS pick was a horrible one to begin with and the right put up such a stink the nominee was too scared to face the Judiciary Committee.) Harriet Miers decided not to be one of the nine constitutional decision-makers of America. In my opinion, it was for the better. But now that she's gone, the question is now raised - Who's next?

On page 4A of October 28th's USA Today, ten candidates are listed with a brief background of each. I delved a little deeper and here's what I found.

Janice Rogers Brown (58 years old): She went to UCLA for her undergrad followed by getting her JD. at the University of Virginia. She wrote a majority opinion while on the California Supreme Court in a case that ruled against an affirmative action amendment. She voted against parental consent law for abortions and may be liked by the Left for upholding a ban on assault rifles. She is now sitting on the U.S. Court of Appeals.

Edith Brown Clement (57 years old): Clement went to the University of Alabama. She now sits on the 5th Circuit and sat as chief justice of the district court (for nearly a decade) she clerked earlier in her career. She is also big on federalism.

John Cornyn III (53 years old): He went to Trinity University and received his JD. from the University of Virginia. He is a former U.S. Senator from Texas and is opposes same-sex marriage. Controversy may errupt because of his declination to sponsor an apology for not passing anti-lynching legislation. He also has an ethics investigation for casino activity under his belt. I guess one thing he has going for him is his criticism of activist judges.

Alberto Gonzalez (50 years old): Asside from his initials also being that of his title (Attorney General), he is also a Texan. He served as an Air Force officer and got his Political Science degree from Rice University. His JD. comes from Haaavad. Liberals would oppose him because he had more executions under his council to Governor Bush than any other. He has a possible connection to Enron who gave him $6500 for his campaign to win the Texas Supreme Court race. Controversy of detainee rights, Freedom of Information Act limits, and Guantanimo Bay doesn't help his case either. He would also make for another cronie pick.

Michael Luttig (51 years old): This guy is as white as John Roberts. He now serves on the 4th Circuit. His degrees come from Washington & Lee University and his JD. from University of Virginia. He has clerked for Scalia and Warren Berger and served a brief time in the White House.

Maureen Mahoney (50 years old): Maureen has argued in front of the SCOTUS and for affirmative action in college admission decisions. She has a Political Science degree from the University of Indiana and her JD. from the Chicago School of Law. She clerked for Rehnquist and would most likely make the conservative base grumble once again.

Michael McConnell (50 years old): From the picture in USA Today, this guy's funny lookin'. But, he's a Kentuckian and has been on the Tenth Circuit for three years. His degrees come from Michigan State and the Chicago School of Law. He clerked for William Brennan and supports a constitutional amendment banning abortion. On the other side, McConnell criticizes the Clinton impeachment and the case of Bush v. Gore. He is, however, big on blending chuch and state.

Priscilla Owen (51 years old): Hey, another Texan...who would have guessed? She now sits on the 5th Circuit and has 17 years of commercial litigation. She attended Baylor University, a Baptist College, and seems smarter than the average bear. Both her undergrad and law school terms she graduated cum laude. Owen also scored the highest score of the year on the Texas Bar Exam. She helped organize Farm Law 2000 which tries to find ways to keep marriages together and understand the ills of divorce.

Larry Thompson: He's the former deputy Attorney General and the New York Times called him a moderate. He is now general council for Pepsico. Controversy may arrise over the $1 million he made as an ad director of Providian Financial Corporation.

Karen Williams (54 years old): Not too much information on Karen. She has 13 years experience on the Fourth Circuit Court of Appeals. She has her degrees from Columbia and the South Carolina Law Center.

What I'm looking for in a SCOTUS justice is a non-crony that takes each case for what it is, doesn't read into it, and decides for that case only. Legislation should be done from Congress, not the Judicial Branch. I also see the Constitution as a somewhat dead document. If it lives, our country dies. Out of these candidates, there are a few that should be nixed immediately:

John Cornyn: Ethics violations are pretty taboo at this point in time.
Alberto Gonzalez (Gonzo): Nobody wants another crony pick.
Maureen Mahoney: The base wouldn't support someone who supports affirmative action.
Larry Thompson: Another corrupt businessman is the last thing we need.
Michael McConnell: I like some separation of church and state and a woman's right to choose. He doesn't.

Out of those not nixed by some random college student from Kentucky, I have narrowed it down to:

Priscilla Owen: She's smart and has experience with the law and being a judge.
Edith Brown Clement: She was already blessed by the base and is big on federalism.
Janice Rogers Brown: She seems right of center, but not right of Rush.

We'll see where things go. Hopefully, Bushie learned from his first mistake - without you're base, you have no one. Stick with the safe picks and don't listen to Reid again. If I had to give my blessing to one candidate, it would be Owen. Hell - Karl Rove for SCOTUS justice. That should be fun.

Big spending is the new trend. The San Francisco Mayor says wi-fi is a citizen's basic right. (San Jose just ok'd it with help from private businesses.) Oh, it gets better. Rep. Stevens wants to spend $3 billion to upgrade everyone's old tv to new digital-ready cable. Let's cut the pork, gentlemen.

Someone finally gets around to making a program for Windows that the Mac has come standard with for years. Always years behind. When will Microsoft learn?

A Collection of Things

I know I don't get comments and readers rarely click on the links I put up, but I will continue (with the "iMixes" as iLounge puts it) until my fingers hurt.

The iPod craze has now stretched into the religious sector. Check out this iPod Shuffle cross called the "iBelieve". I really couldn't help but laugh.

On the other end of the racist spectrum, white supremecists are using young girls to spread their hate.
On page 14A (and here)of USA Today there is a graph with statistics that show young children's idea of sex. According to the study conducted in 29 states, nearly 60 % of college students say that oral sex isn't really sex. Just some food for thought. I could ramble for hours on the conclusion.

A Hooker's Resume

If I was to submit a resume to a pimp for employment, here are some key points I would include to put me ahead of the rest of the whores.

- Won't bite off more than she can chew
- Able to meneuver in difficult situations
- Willing to bend over backwards for a customer
- Always willing to take work home with her
- Experienced with the latest technology
- Able work on the road
- Willing to let other employees help on a job
- Knows who's boss

A Letter to Democrats

Dear Democrats,

It's not often I offer my opponent advice on how to beat me, but considering I am but a small voice in the political realm and you're very stubborn in your liberal ways, I am offering you some ways to improve your party and with the 2006 and 2008 races. Here goes.

- Get rid of Dean. The DNC head is giving your party a horrible image. His words serve as terriffic ammo for the right-wing pundits and talkshow hosts. A more suitable leader would be left of center, not left of liberal. Fire Dean and put up...say... Liberman... and become the new party of the people. Each side is looking to gain that undecided vote, and having Dr. Dean up there leading the ultra-left agenda is not a way to win those types of votes.

- Learn from Dean. Grassroots campaigning is now the wave of the political future. Be the party that passes out flyers, raises money online, and calls people up for contributions. Not only is it cleaner (no lobbyists taking you on golf trips), but it will raise more money and bring more voters.

- Get a younger look. MTV has their "Rock the Vote" thing every few years and attempts to get out younger voters. For the most part, younger voters lean left. This is your chance. Give up on trying to elect old fogies like Reid and Boxer. Barack Obama is an up-and-comer that is popular with the youger crowd along with the black voters. Your man Paul Hackett was a huge success and could be your ticket to winning key states like Ohio.

- Be the bigger man. In your campaigns, put out positive and patriotic ads. Leave the attacks on Republicans to the bloggers and Al Franken. Getting a hit radio show that isn't ultra-left wouldn't hurt either.

- Revamp your immigration and abortion policy. Immigration is going to be a big issue in the next few years. Bush has yet to really jump on it. Take a cue from Hillary and come out and say what America wants to hear - "put an end to illegal immigration." All abortions - All the time is not the answer. Typically, Americans don't like abortion but are willing to let women have the right as long as it's necessary. A good idea would be to come out against partial-birth.

- Have an answer to a problem. I know it's tough being the minority in all three branches, but have a solution. Come up with a well-thought-out policy on what to do in Iraq, gas prices, and other key issues. Bashing the administration and the majority will not get you votes, it will only make you seem ultra-liberal and ensure your stay as the minority party.

I know this is a lot of work. You would basically change your entire party. But these are just a few ideas to help you win votes to become the party of the people and take over the house in 2006 and the senate and white house in 2008. Hopefully, no one important will read this and take my advice. But if they do, and the donkeys take over, don't blame me.

Steve's Big Day

I was on the edge of my seat for about a week anticipating the newest iPod introduced last Wednesday. At first, I wanted everything they had introduced: video iPod, new iMac, iTunes 6, and FrontRow. I was administered a chill-pill and gave them all a few days thought. The new iPod is a great start. Much like the iPod nano, It will scratch. For a device that is for playing videos, this may not be the greatest. The selection on iTunes movie store is so limited right now that it is not worth my 300 bucks. Once the O'Reilly Factor, Commander in Chief, Family Guy, The Simpsons, South Park, news clips, and other great shows start making appearances (especially for less of a fee), I will give the new iPod more consideration. The new iMac is not for me, but will definitely sell well. FrontRow is something great but, like the iPod, can be improved upon. I don't use my computer for watching movies nor is it in my living room. If they include a way to watch tv, more importantly cable, on the iMac, they'll have another customer and I can sell my TV.
What few are reporting on is the new attire of Steve in his keynote. No blue jeans! No sneakers! Steve! What are you doing?! Losing the jeans is a slippery slope. Next you'll be wearing a red polo, and one day you'll be wearing a green leisure suit with fish swimmin' in platform shoes. Don't let us down. Put back on the Levi's.

Preach What You Practice

I spent a few days up in Albany, NY with some friends. It really was a great time and there were great discussions concerning politics and current events. (I got a good dose of C-SPAN and FoxNews.) Three proud democrats went back and forth with me for hours. We started talking about foreign and domestic policies. I noticed that one guy I was talking to had the same opinions as the conservative base. He was for immigration reform, tightened borders, personal responisbility, a traditional marriage, welfare reform, more money for veterans and troops, lower taxes, judges that don't legislate from the bench, more attention to our national defense, and he loved America. His core beliefs mirrored those of conservatives, but was a proud Democrat. His main grief was with Bush and the Iraq War. I though I had a potential flip. I have many problems with our current administrations, their actions, and their lack of, but my core values and policy beliefs keep me registered Republican.
I think there are many people out there that want the best for America and its traditional upbringing, but due to the well-publicized notion that Republicans hate blacks and the poor/working class, those that would be happy on the conservative side are turned away. My suggestion is for everyone take a look at the party that best reflects your personal views and open your eyes and mind. You have a lot more in common with conservatives and liberals than you know.

This entry was written on October 15th. I'm just now getting around to posting it.

Madonna is telling people she won't allow her children to watch MTV, read magazines, or watch vulgar movies. I'm glad to see the material girl that once pranced around barely naked, put out a sex book, grinded on a bed onstage, and put out erotic music videos is finally coming around. I guess it's o.k. to make money off of other children's interest in sex, but god forbid her children see the bad stuff on MTV.

The Constitution of Iraq is being voted on today. I'm so very proud of our leaders' and soldiers' achievements in Iraq. Let freedome and democracy spread. Hooah!
*UPDATED (10/16/05) I'm very impressed with the expected 61% voter turnout. Hopefully, non-voters in America will take a cue from the Iraqis.

The same man who called for the death of Venezuelan dictator, Hugo Chavez, is claiming God is pissed. Pat Robertson is forseeing the endtimes due to evidence of all the natural disasters. If the end is coming, I'm screwed.

No More Yanks

I've been missing a lot of baseball lately, but caught the end of the 3-2 Yankees game the other night. Quite a nail-biter. It's down to the Angels vs. the White Sox and the Astros vs. the Cardinals. I'm not a huge fan of any of these teams (Cincy, Boston, Cubbies, Mets are my favorites), but I'll be rootin' for Saint Louis. The best part of this season is the lack of Yankees in the playoffs. The baseball part of me couldn't be happier.

A Peter Griffin Rant

Those who know me, will understand this post:

You know what grinds my gears?! Cursive writing! Honestly, what's the freakin' point? Does anyone use cursive anymore? I can't even read it. The professional world doesn't use it. The only purpose of cursive writing is to give second graders something to do. Let me give a quick suggestion. Nix the cursive and implement typing. Teach kids to type. They'll need it a lot more than cursive when it comes to college, jobs, and finding music to steal. They can spend all day texting their friends, they should be able to type at a quick rate. Cursive is a dead way of communicating and should not be taught to children. Let's phase it out.

Score: ACLU-1, America-0

On Thursday, the ACLU won their case in front of Judge Alvin Hellerstein. This Clinton-appointed judge ruled that 74 pictures and three videotapes of torture in Abu Ghraib prison should be released for the world to see. He claims that terrorists "do not need pretexts for their barbarism." In part, he's right. They don't need pictures to help motivate them to slaughter innocents and prevent democracy from spreading, but damn if it doesn't help them. Terrorist propaganda is spreading faster accross the internet and throughout the Middle East. The pictures that are to be released can be used for recruiting future terrorists and fueling the flame of hatred toward America.

I do not think these pictures should be suppressed forever, but while evil-doers are actively trying to destroy America and its projects for peace, these pictures should not be released for the public or the terrorists to see. Judge Hellerstein and the ACLU have proven that there are still enemies working to destroy the American way. This time, the enemies of America are Judge Hellerstein and the ACLU.

After the wife finishes work, we're going to The Pub. It's a new restaraunt on Dixie Highway. I am really looking forward to a relaxing night.

Could It Be? Is It True? (Updated Regularly)

Apple has announced a "One more thing..." event for October 12th. The picture shows movie curtins behind white text. Most are speculating this will be the unvailing of a video iPod of some sort. Keep your fingers crossed. I know I'll be kept awake at night wondering what it will be.

*UPDATE: (10/5/05) Engadget and Apple Insider are both making similar speculations. From the comments on Engadget, the picture seems to be fake.

*UPDATE: (10/5/05) ThinkSecret is speculating new Powerbooks instead of a video iPod. Hell, I'm hopin' for both.

*UPDATE: (10/6/05) Fox News has hopped on the video iPod bandwagon. They're saying sources are pointing to yea. "All the signs point to a video iPod," said Tim Bajarin, an analyst with Creative Strategies. "But you've got to remember, the thing with Apple is, our guesses are almost always wrong."

*UPDATE: (10/6/05) Now Engadget is claiming that the video iPod was a blown up tease for Apple-lovers. Gizmodo claims the same. Their source is Think Secret, so I have doubts. They might just be playing on Apple's good side because of the pending lawsuit.

*UPDATE: (10/7/05) TUAW is throwing their hands up in the air. They don't know, but more evidence is coming to the surface. And some people have extra time to delve into old interviews to help support their argument for or against the iPod video rumor. (Unlike some people who post on a blog to procrastinate Constitutional Law research.)

*UPDATE: (10/7/05) Dreamhost says an iPod video is unlikely, but a vTunes (kinda like airtunes) is more likely. "People download movies/tv shows/music video/flash animations/porn from the vTunes Video Store." Your Steveness, you're driving us all crazy... and we love it.

*UPDATE: (10/10/05) Think Secret is now speculating two new iPods will debut on Wednesday. They are expected to come in the white and black colors. Another site says they will debut a pink Madonna-edition iPod like the U2. It looks like everyone is straying away from the video iPod speculation. I guess it's a lost cause for now.

*UPDATE: (10/11/05) Everyone is on the edge of their seats hoping for the most from Apple. Think Secret changed their mind and says a video iPod is now probable! What is certain, however, is there will be a new iPod out tomorrow. In about 12 hours, I guess we'll know. I get out of class at 0850 and will be on the computer shortly after. (My nerdiness is increasing by the minute.)

New Money

I can see a bunch of coin nerds sitting around contemplating how to make money more friendly. Starting circulation in 2006, the new nickel will feature Thomas Jefferson with a hint of a smile. It will also have the word "Liberty" inscribed on it in Jefferson's own handwriting.

This comes days after the announcement of the brand new ten dollar bill. I can understand the need to prevent counterfeiting, but a fancy new nickel...? Seriously, does it really make a difference? Will anyone ever pull out change for the coke machine and think, "gee...Jefferson was a really swell guy."?

I'm not opposed to the new coin, but just find it a little silly for the normal history-unappreciating public.

A Bad SCOTUS Pick

It's not just about abortion. This year's SCOTUS docket is filled with hot-button issues. This makes Bush's new pick for the court seat even more crucial.

Physician-Assisted Suicide - Gonzales v. Oregon
Military Recruiters and Campus Access - Rumsfeld v. FAIR
Toture - Hamdi v. Rumsfeld
Abortion - Ayotte v. Planned Parenthood
The Pledge in Schools - Michael Newdow's case
I'm sure the constitutionality of the USA PATRIOT Act will come up as well.

With every presidency, the executive branch has lawsuits filed against them that eventually reaches the Supreme Court level. With these, I'm seeing a trend. Some of those involved in these cases are direct assistants to the president. Bush has picked a person close to him with no record for the Judiciary Committee to question. As a personal aide, Miers is succeptable to Bush pushing her to vote a certain way. I am not saying that her ethics are in question. I do not know her. What I am saying is that based on the shady history of this Presidency, mobster tactics could be used to push her to vote in favor of what is in the best interest of the Bush folk and not the country. "I put you there, now you owe me."

This is pure speculation and the more I find out about Mier, the more frustrated I get with the decision to nominate her. Bush said this morning that she was the most qualified person to fill a Supreme Court seat. I guess it's a matter of opinion. Conservatives and Liberals alike have their picks for a better SCOTUS justice. It just so happens Bush didn't listen to either.

The New Girl

Sometimes I hate being right. It looked from the beginning like Bush's pick of Miers to the SCOTUS would bring on heat from both sides. Boy, was I right.

Both sides are complaining about the cronie-aspect. She was never a judge and has been one of Bush's closest advisors since Texas. The far left is whining because they hate anything Bush does. The right is complaining that they voted for a man that would uphold their conservative values and he nominated a woman based on anything but.

Here's the way I'm seeing it. Bush is doing his best to get his ratings out of the gutter and get some appreciation from the Left. He most likely ignored his advisors' options and picked someone he thought the Left would like and the Right would settle with. In trying to please both parties, he's enraged both. Both Limbaugh and Franken are up in arms about his pick. Bush is trying to bring the country back together in an attempt to leave a legacy of a unified nation despite its turmoil. George, listen to your advisors. That's what they're there for.

I was hoping for at least a "Scalia-light". That is, someone that upholds the conservative values but is not as blatently opinionated as Antonin. I guess sometimes, you don't get your way. I know Shumer and Reid got theirs.

Back From The Field

Sorry I haven't posted in a while. I've been in Fort Knox the last four days on a field training exercise.

Here's some stuff to wet your whistle:

Bush nominates Harriet Miers to the SCOTUS. Sadly, I feel this pick was another attempt at bringing the dems and repubs together. If pitting both sides of the Senate against you, then I guess he did bring them together.

Former NYC mayor and national hero Rudi Giuliani says he is considering running for president. I'm sure he'll be on the elephant ticket, but he'll have a tough time in the primaries due to his moderate stance on a lot of key conservative issues.

I watched "Commander in Chief" last Tuesday and am already hooked. I work on Tuesdays, but will try to catch it every week. I know it's an attempt at getting Hil into the White House seat, (even Donald Sutherland, a key actor on the show, said "Bush will destroy our lives") but I just love the executive branch.

A French-controlled island is using dogs for shark-bait. I smell something...fishy... going on here. (Please excuse the pun.)
